Cleveland Heights Man Is Sentenced To 30 Years To Life In Prison For Aggravated Murder

James Montgomery was convicted of stabbing David Fraser

 

A Cleveland Heights man was sentenced to 30 years to life on a count of aggravated murder Wednesday.

James Montgomery, 25, had pleaded guilty to the murder charge on January 10 in Cuyahoga County Common Pleas Judge Janet Burnside's court.

On December 22, 2011, the victim, 49-year-old David Fraser, of Cleveland, was stabbed to death in his apartment on Lake Avenue.

Fraser's television, wallet and cell phone were missing.

DNA found in the Fraser's apartment matched Montgomery, according to the Cuyahoga County Prosecutor's Office. Consequently, Montgomery was arrested Feb. 8, 2012.

Montgomery has a criminal record. He was convicted of two counts of aggravated robbery in 2007 in Cuyahoga Court of Common Pleas.

The judge sentenced him to four years in prison. He was on parole for these crimes when he murdered Fraser.

I don't go to Church, but I would never murder someone!!! Please!!!!!! Get this: I am Jewish, married to an Athiest, who used to be Catholic, who's Mom is Catholic and who's father was Protestant. We are good people. We compost what we can. We try to take good care of the Earth. We shovel our neighbors' walks without being asked. We try not to be prejudiced against people with different beliefs, lifestyles, or race, etc..... Get the picture? "We are Cleveland Heights!"

And what if he did go to church? Then he might have had the opportunity to get "touched" by one of these filthy pedophiles. You know the priests who supposedly swear and oath to God, who lack the discipline to control their twisted urges? Church is not a cure all Dave. One might even argue that church has been one of the most corrupt organizations in the history of man. Look up the dark ages, look up the papacy. The church claims to lead the sheep to the Shepperd, but what they really do is lead the sheeple to the slaughter. Jesus said you don't need a church to come to me. Get it Dave? Man is severely flawed and it would probably be in one's best interest to avoid being tainted. The church has an agenda and I hate to say this,but chances are it is not in your best interest. The church is one of the many pacifiers for the people. I just watched this thing on date line last night and it was a story about a pastor. This guy killed his wife and was a sexual deviant inviting himself into his congregations bedroom. I'm not saying all churches are bad, but I have seen congregations full of hypocrites who know neither the definition of Love nor God. Think about those young boys and girls whose innocence was taken away from them. Ask them if they go to church Dave. You people really need to pick up a book. The road to hell is paved with good intentions.

Dave and Nate (May I call you that?): Church helps some people, I am told, and that is nice. I respect that. Many of my friends are Churchgoers. What bugs me are those that go to Church every Sunday and ask for "forgiveness for their sins," and then go and commit the same sins the next week. They are hypocrites. Maybe this man did go to Church regularly. (or Temple- he could be Jewish; people keep forgetting about us. I am a "good NON-Christian;" not a rare breed.)

He could have come from a fatherless home. Or a home with a father who paid no attention to him. Or a home with a father and no mother. Kids are not always easy to raise, and it is better for them to have 2 parents together, to raise them.* That doesn't mean that one parent can't do a great job, though. Again, I know many single parents who did a great job with their kids, outside the Church. They came home tired from work, and still found time to READ to their kids, and supervise homework. They went to parent-teacher conferences, and supported the teachers. They set limits. They hugged their kids. They did struggle, but they also sacrificed for their kids. The children of my single-parent friends have managed to grow up and be good law-abiding citizens. (* 2 parents incl. 2 of the same gender)

30 years seems harsh, the murder may have taken place after a illegal entry made by the above person in question , it is not uncommon in high crime rate areas for such events of aftermeurth to occur, and to go on one string of DNA is inconclusive, and stronger evidance has to be submitted to the courts for the sentance to stand firm.
