County Court Orders MYXX To Shut Down By Oct. 1

Cleveland Heights City Council declared the business a nuisance at its August meeting, and took the Cedar Fairmount establishment to court.

A Cuyahoga County Common Pleas Court judge has issued an order for to shut down on or by Oct. 1, 2012, according to a press release from the City of Cleveland Heights.

In addition, the restaurant/lounge, located at 12459 Cedar Road, has to follow new hours and rules. MYXX must close by 1:30 a.m. Fridays and Saturdays, midnight on Sundays and 1 a.m. on Thursdays. No more than 400 people will be allowed in the 9,600-square-foot space one time.

"The city is grateful for the order issued by Judge Daniel Gaul with this difficult situation," Mayor Ed Kelley said in a press release. "I am counting the days until Oct. 1."

City Council declared the Cedar Fairmount business a nuisance at its and authorized the law director and city manager to abate the nuisance.  

After that meeting, Law Director John Gibbon filed a complaint with the Court of Common Pleas seeking a restraining order and injunction. Gaul issued the order at a hearing Sept. 12.

According to council documents, the city manager and police chief have “reported that , including aggravated riot, assault, assault of a police officer, fights, underage consumption of alcohol, public intoxication, open containers of alcohol, excessively loud music, disorderly conduct and public urination have occurred and are habitually occurring at and around the business.”

The and law department will continue to closely monitor the situation until MYXX closes, according to the press release.
