Oakwood Rezoning Issue Now on November Ballot

Issue 96 asks South Euclid residents whether the former Oakwood Country Club should be rezoned from residential to commercial so that developers can build there

The issue asking South Euclid residents whether the former Oakwood Country Club should be rezoned is now on the November ballot, according to the Cuyahoga County Board of Elections website.

Issue 96 reads, “Shall Ordinance No. 05-11, proposing to amend the zoning map of the City of South Euclid so as to change certain property known as the Oakwood Club from its existing Class R-75 “One-Family Residential District” to C-2 “General Commercial District” be approved?

But a group of residents in South Euclid and Cleveland Heights called Citizens for Oakwood and to put a referendum on the ballot and put the decision to the people.

The City of South Euclid followed the court's ruling and at Monday's council meeting.

First Interstate has asked the court to reconsider its decision to allow this issue to go on the November ballot because it was passed as an emergency ordinance. Under the Ohio Revised Code, ordinances with emergency clauses are not subject to referendum, and the company argues that state law should override South Euclid's charter, which allows emergency ordinances to be subject to referendum.
