Cleveland Heights City Council declared the business a nuisance at its August meeting, and took the Cedar Fairmount establishment to court.
A Cuyahoga County Common Pleas Court judge has issued an order for MYXX to shut down on or by Oct. 1, 2012, according to a press release from the City of Cleveland Heights. In addition, the restaurant/lounge, located at 12459 Cedar Road, has to follow new hours and rules. MYXX must close by 1:30 a.m. Fridays and Saturdays, midnight on Sundays and 1 a.m. on Thursdays. No more than 400 people will be allowed in the 9,600-square-foot space one time. "The city is grateful for the order issued by Judge Daniel Gaul with this difficult situation," Mayor Ed Kelley said in a press release. "I am counting the days until Oct. 1." Cleveland Heights Police called for mutual aid from Shaker Heights and arrested four people.
More than a dozen police officers were called to MYXX at 2:27 a.m. Sept. 3 to calm a disturbance outside of the Cedar Fairmount business. Cleveland Heights Police called for mutual aid from Shaker Heights, and 15 to 17 officers were on the scene. According to police, there was a large crowd outside of the bar and lounge screaming, and some patrons attempted to engage in a fight. Police arrested four men involved in a brawl. Leon Dye-Booker, 22, of Cleveland Heights, Garrison Davis, 20, of Euclid and Davon Gravely, 21, of Cleveland were charged with disorderly conduct, and Sonny Ali, 33, of Cleveland, was charged with obstructing official business, police reported. Police Chief Jeffrey Robertson said the police department closed the establishment Sunday night because MYXX didn’t have a proper permit for an event.
Four police cars with lights flashing were parked outside of MYXX Sunday night. Officers were there to disperse and monitor the crowd after the police department shut down the establishment for the evening. Police Chief Jeffrey Robertson said MYXX didn’t have a rental hall permit for a party they scheduled there June 24, so they closed the business for the night. Police say 300 people leaving the bar spilled out into the Cedar and Fairmount intersection last weekend.
A car struck a police officer and someone knocked out a man during a disturbance outside of MYXX after 2 a.m. June 17 that police called a melee. A lieutenant patrolling the area called in a fight outside of the business, and residents reported they heard gun shots, although police did not find any evidence to support that. About 300 people exited the bar and dispersed in all directions, blocking the entire intersection of Cedar and Fairmount, police said A police officer trying to clear the area was hit by a car after she had asked the driver to stop. FutureHeights is hosting the event as part of its speaker series.
Cleveland Heights Police Chief Jeffrey Robertson and University Heights Police Chief Steven Hammett will meet with residents at MYXX at 6:30 p.m. Wednesday, June 20 as part of the FutureHeights Speaker Series. The chiefs will discuss new initiatives, how they work with other departments in the area and how citizens can help improve safety in their communities.
